If we have a depot in Bombay, is it required to register under the Bombay Shops and Establishments Act of 1948?

Hi,

Yes, if any manufacturing process or activity is going on in any part of the building, you also need to apply for a separate license for factories. Please refer to the definition of a manufacturing process as given in the Indian Factories Act, 1948 in the attached file.

"Commercial Establishment" means any premises, not being the premises of a factory or a shop, wherein any trade, business, manufacture, or any work in connection with, or incidental or ancillary is carried on for profit. It includes premises wherein journalistic or printing work or the business of banking, insurance, stock and shares, brokerage, or produce exchange is carried on, or which is used as a theatre, cinema, or for any other public amusement or entertainment, or where the clerical and other establishment of a factory, to whom the provisions of the Factories Act 1948 do not apply.
