Encashment Of PL/EL

Hello Friends,
Please clarify the following
1) Is there any particular rule or policy regarding the encashment of PL or EL.
2) How many leaves can be accumulated and carry forward for the next year.
3) How many days can be encashed at a time.

Dear Priya,
As per rule 15 Minimum EL should be given to every person. But if Company want it can be enhanced. It is depend on company policy. Any person is entitled for EL after one year of Job. The rule of EL is (Last year working days / 20) but minimum working days 240 should be required for EL. If any person have balance EL in previous year the balance leaves will be carry forward for next year. If any person have balance leave and he is giving his resignation in that situation company should pay for his balance leaves.

Hi Raj,
Thanks. i have two doubts,
1, if a person working for more than 3 yrs in a company and havent taken any leave from his date of joining then how many leaves will be carry forward to the next year. eg. In our company every employee will be getting 12 days in their Leave account once in six months.
2, If any employee who resign from the company within one year but completes six months then the EL 12 days in his leave account will be paid for him or not.
Need help in this.

Dear Deborah,
1) As per factory Act if any employee don't take EL the maximum EL will be 30 but it is also depend on company policy. I have seen that some company employees have 130 EL. But as per factory Act Minimum 15 and Maximum 30 EL. So you can discuss with management if management want than you can carry forward more than 30 leaves.
2. you did not clarify that 12 leaves in six months is all EL or total of EL, SL and Cl. please clarify but if any person resigen within one year in that position company will pay for all EL . I think you have got your answer. if you have any query please feel free to ask.

Encashment and carry forward of leave is provided in Factories act, applicable to factories.
Other organisations not cover under the same may define its own rule

Dear Priya,
1. If your company is covered under Factory Act - Refer to chapter Viii of Factory Act for Leave Rules. However for every worked 240 days your eligibility for EL starts.
2. Accumalation of Leave depends on Company Policy.
3. Encashment of Leave is made on Basic earning of a employee.
