Festival Falls On Sunday

Hello Seniors...
I am working as HR cum Personnel Professional in Faridabad Haryana.
I want to know that we have company policy that we provide 8 festivals leave in a year.
we have declared the diwali as festival leave in 2013.
But diwali festival falls on sunday and sunday is the weekly off leave.
So in this regards i want to know that is there any criteria for settling this leave.
or is there any law for settling this.
My employer is telling me it is not mandatory to give another leave instead of diwali festival falllson sunday.
So please tell me.
is it necessary that we should provide 2 leave (one for weekly off and second for diwali falls on sunday)

Your simple query is if a festival holiday falls on a weekly off day, then whether an additional holiday is granted or not. One gets confused by your use of word "leave".
Generally, when any festival holiday falls on a weekly-off day, then no substitute holiday or any compensatory holiday is granted. I have found this policy in many companies. But, these are policies and not rules of law. You can have a considerate view and you can decide a policy that a certain number of holidays falling on weekly-off day will be either paid extra or will be compensated as an extra holiday etc. You may have to find out what policy neighboring industries are following. Accordingly you can decide.

in future while finalizing give 8 holidays without counting holidays falling on sun day.now you can give another holiday to substitute it

Hi Vikas,
There is no law which force to give substitute off if one falls on Sunday or on week off. If you celebrate any festival in office (like Republic day & Independence Day) then you should give one compensatory off as employees came to office on that day.
Generally organizations follow holiday list issued by some Banks or Government Organizations, which is nearly 12 to 16 days.
But if you fix only 8 days then you can remove the festivals from the list which falls on week off.
It totally depends on your wish if you want to give another off this time or not.

Your company has decided to declare 8 holidays in a year. Year after year you will find that some holidays fall on Saturdays or Sundays.

Hence, my recommendation is while you finalise holiday list for the succeeding year in November/ December of the calendar year, please ensure that you declare 8 holidays (including the mandatory national holidays) that fall between Monday to Friday, if your establishment is following a 5 day week. By this you will ensure that employees are assured of atleast 8 holidays in a year.

Some companies substitute holidays falling on weekly off by giving an alternate festival holiday.

If employees work on a weekly off they must be given a compensatory off either 3 days prior or 3 days after the day on which they are required to work.

If the establishment follows a 5 day week pattern, if they work either on Saturday or Sunday they will have to be paid double wages on the day they are required to work. If they are required to work on Diwali day that falls on a Saturday or Sunday they will be entitled to get double wages for working on that day while others who do not work will get single wage by default.

i would dearly appreciate it if anyone can share their Company's holiday policy. I am not looking for the list of holidays, but i am looking for a concrete policy with framed sentences so that it will be helpful for reference purpose.

01. I have more then 70 Employees working as Team member (Staff) in which some are Graduates & remaining are ITI's
Kindly clarify that these Employees comes under which category (Skilled,Semiskilled or Unskilled)

There are 5 categories
1. Unskilled- Peon, Watchmen, Sweeper, Helper, Worker, Gardner, painter.
2. Semi Skilled- those are not so much educated but trained like junior machanic,driving.
3.Skilled- Those who have diploma and degree and working on operatory level or clerical level, like electrician, machanic, fitter, welder, clerk etc..
4. Highly Skilled- those who have graduation and working on assistant level or executive level like personal assistant, exceutive professional.
5. staff- those who are top of the level like manager,
