I was employed in a startup Pvt. Ltd. Company in Pune, where only one person was handling the company. There was no HR or Finance department. I wasn't feeling well, so I informed about medical leave, but it was canceled, citing urgent work. However, I was not assigned any work, so I emailed him that this was insensitive behavior. The next day, I took leave. When I resumed work the following day, I was informed that I had to resign. I didn't serve the notice period as I was asked to resign on the same day.

When I asked for my salary, experience letter, and relieving letter on 5th September, I was informed that I had been terminated. Now, he is threatening and warning me, saying he will tarnish my image in front of my parents. What should I do? On 17th September, he provided me with the relieving and experience letters after I mentioned that if I was terminated, I should receive my salary and letters within 24 hours. I am being mentally harassed, and I can't concentrate on anything else. I request your help.

Thank you so much for all your replies, but I'm still clueless about handling my situation. I didn't serve the notice period, and there is no proof that the employer asked me to leave immediately. In this situation, what are my rights? Will I be getting my last month's salary? Although I got a relieving letter and an experience letter stating that my dues will be settled, can I file a case? Please help me with this one.

In this case, you will be getting your PF – no employer can stop the PF. Secondly, as they have given you an experience letter, it states that you have resigned from the company of your own interest. So, it is better to have your experience letter to show that you have worked, and you can try elsewhere.

Regarding your last month's salary, do keep them posted through your emails to the head of the department, escalating the issue. If they do not respond, you can proceed to the nearest labor officer and lodge a complaint against the employer by showing your follow-up emails regarding your salary.
