Hiring Bangladeshi Nationals in India: What Legal Steps Should I Follow for an Employment Visa?

Dear Seniors, I am working as an HR in a Pvt. Ltd. firm in India. We have recently hired a Bangladeshi national for our firm in India. The recruitment and selection process was done online. Now, I would like to know what the legal formalities are that a company should ensure in order to hire a Bangladeshi national to get the Employment Visa from the embassy office. Please tell me the process to hire a Bangladeshi national in India.

I am wondering what category of employees you are hiring from Bangladesh that you don't have in India. Having said that, here is a link that will help you in your task if you still decide to get the candidate from Bangladesh: High Commission of India, Dhaka, Bangladesh.

Ideally, all companies in India usually tie up with a licensed Bangladeshi Overseas agent who will help you with all your procedures and formalities.

Thank you very much for your valuable response. I did see the website. It says:

- Testimonials of interviews in India
- Copies of press notifications in India regarding the post

Along with the other documents... but our interview was through Skype, and the job posting was on the Naukri portal. So we do not have any such proof like press notifications or interview testimonials. Will the Embassy accept online interviews and job posts, etc.?

We are hiring VOIP (Voice Over Internet Protocol) professionals. You'll find very few of them in India from a similar background.

It's great to have a hire outside India. Didn't you get a match here? Just go for a BGV check, including his credentials (educational, nationality, employment, criminal records), so that at least you can be satisfied that you have done justice to the hiring process apart from the selection. You need to check with the Embassy on the requirements. Put forth your case and see if you can obtain a work visa.

Let me get this clear: You are not getting VOIP professionals in India and have to hire from Bangladesh? This does not ring true, and the embassy/work permit department is not likely to accept that either. There are a number of people here who have worked on and are working on VOIP projects. It looks like you are getting someone cheaper there than you will get in India. I am not sure if that is grounds for employing foreign nationals in India (unless some bilateral treaty has been signed with Bangladesh for employment).
