Employee Resigned After 7 Years: How to Legally Claim Unpaid Gratuity?

I want to know if an employee resigns from his job after completing 7 years, and if the proprietor is not paying his gratuity, what legal steps can be taken to claim his gratuity. Please help me regarding this matter.
