Navigating ESIC Registration: Does My New Hire Need Separate Coverage from Her Husband?

Dear Seniors, I have taken on a new employee who needs to be registered in ESIC. Her husband is employed in a private company and has already registered her name in ESIC. Now, my question is whether she needs to be registered again through my company or if she can continue with her husband's registration.

ESIC Coverage for In-Laws

I believe that fathers-in-law and mothers-in-law are not covered by ESIC. Please correct me if I am mistaken.

Registration Process for New Employee

If she does need to be registered through my company again, should her husband's details be entered as well, or should only her name be registered?

Employee Registration Under the ESI Act

The registration of every coverable employee under the ESI Act is required to be separate. When a new employee joins, their particulars on the Declaration Form must be filled out and submitted to the appropriate Branch Office within 10 days. The employer is responsible for completing all such formalities.

You can view the columns in the Declaration Form and fill them out accordingly. A separate Identity Card under the ESI Act must be issued to all the Insured Persons.

Insurance Numbers for Employees

Separate Insurance Numbers will be allotted to all employees regardless of any relationship with any other employee who already has an Insurance Number or is covered.

Let's apply logic here and conclude that if the employee is not registered in ESIC, she will refrain from paying the ESIC contribution. What will be your justification during an audit/ESIC inspection? Please think it over, and you will resolve your query.

Clarification on ESIC Registration for New Employee

In continuation of the points Mr. HK Mehta has mentioned, I would like to clarify that this new joiner is your employee. You have to provide/help to get all statutory and other benefits for each and every employee subject to eligibility. Please do not be concerned about whether this lady is covered under her husband's scheme or other family members' scheme. For your company, she is an eligible and independent employee, so please cover her in the ESI scheme. In fact, she can cover other family members under her primary membership for benefits.

I could not see coverage of in-laws in the definitions, as well as restrictions on covering the dependent spouse who is also working. May experts in this subject help in this regard?
