My friend was working as an officer in a scheduled bank. She was in her probationary period. Due to heavy workload and better placement, she resigned from her job. Now the organization wants to take revenge on the employee (this is happening to all outgoing employees). They have asked her to work for 3 months continuously without leave, and only then will they accept her resignation. On the contrary, her colleague, who joined in the same cadre on the same date, was relieved within a month after receiving Rs. 10,000 as compensation. Another colleague, who also joined in the same cadre on the same date, was relieved after receiving 3 months' salary as compensation.
How could the norms be different for individuals of the same cadre? Will it not affect the right to equality?
My friend is not able to stay for 3 months as her joining period with her new employer is only one week. She is afraid to tell the truth to the bank as she fears heavy compensations, possibly exceeding Rs. 1 lakh, as some employees have faced this.
She did not sign any bond or contract specifying the duration of her employment with the bank. However, she did sign her joining report agreeing to abide by the rules and norms of the bank. Additionally, no rules and regulations have been made known to her so far.
In this case, how would you advise me to handle this situation? Please guide me legally and tactfully to resolve this amicably, considering the very limited time available.
