Am I Eligible For Gratuity - And Is It Calculated On The Basic?

Hello Everyone,
I am working in a BPO as a supervisor. I joined that organization back in 2008. I will be leaving this company by start of the next month. Between this tenure, I had leaves of almost more than 3 months. I was not provided any information about gratuity when I joined and I joined on the executive level. It has been more than 3 years since I am working as a supervisor.
Please advise if I will be eligible to get gratuity. If I am eligible then will it be counted on my basic? I asked my HR manager about Gratuity once but she said that they pay it in our monthly salary. I checked by salary slip and no bifurcation was there on it about Gratuity.
Please advise.

Hi,
Your eligibility of Gratuity depends on completion of continuous 5 years of working with the organization. So it all depends if you have join the organization before October 2008. If yes, then you are eligible for Gratuity, irrespective of leaves that you have taken, because you were in continuous service for atleast 5 years with an organization.
Even if there is no bifurcation of Gratuity in your Salary Break-up, the organization is liable to pay you Gratuity as per act.
