Gratuity Confusion: Am I Eligible and How Is It Calculated on My Salary?

Hello Everyone, I am working in a BPO as a supervisor. I joined that organization back in 2008. I will be leaving this company at the start of next month. During this tenure, I had leaves totaling more than 3 months. I was not provided with any information about gratuity when I joined; I joined at the executive level. It has been more than 3 years since I started working as a supervisor.

Eligibility for Gratuity

Please advise if I will be eligible to receive gratuity. If I am eligible, will it be calculated based on my basic salary? I inquired about gratuity with my HR manager once, but she mentioned that it is included in our monthly salary. I checked my salary slip, and there was no breakdown or mention of gratuity.

Please advise.

Your eligibility for Gratuity depends on completing continuous 5 years of working with the organization. So, it all depends on whether you joined the organization before October 2008. If yes, then you are eligible for Gratuity, irrespective of the leaves you have taken, because you were in continuous service for at least 5 years with the organization.

Even if there is no bifurcation of Gratuity in your Salary Break-up, the organization is liable to pay you Gratuity as per the act.
