I have been working with an organization, XYZ. I resigned on 30th May 2013 due to some internal issues. According to the company's policy, I was supposed to serve a 1-month notice period, but my reporting manager and HR called me and informed me that I didn't need to serve my notice period. However, they didn't give me any written statement for the same; it was just verbal communication between us. I didn't ask them for any written statement as it was my first job, and I didn't have much knowledge about such matters.
Notice Period Salary Claim
1. My first question is, can I claim my notice period salary for June?
On 31st May, they asked me to sign the F & F form, from where I had to take all the clearance signatures from all the departments, including the accounts department. It was written that after 3 weeks, I would be getting all the settlement amounts and the release letter. After 4 weeks, I emailed my HR to get necessary updates, and the next day, I got an email from my HR and the accounts department stating that I have 17 days of LWP (Loss Without Pay) in the month of May, and I have to pay that amount to get the release letter and PF. Reportedly, I called them and emailed them, stating that I left the organization on 31st May 2013, and until 31st May, my LMS was updated as OD (On Duty), which had been approved too. The shocking thing is that all these things were known by my reporting manager and HR.
After some time, my three HR representatives called me (A, K, V) and gave me different statements:
- Mr. A said that I have a total of 9 LWPs.
- Mr. K said that they revised all my ODs and made them LWP.
- Mr. V said I have a total of 17 LWPs, and if I don't pay, they will take legal action against me.
Revival of LMS and ODs
2. My second question is, can they revise my LMS? How can they convert all ODs to LWP?
As per my knowledge, LWP is deducted from the salary amount, whereas in the month of May, I received my full salary.
A few days ago, I came to know that they did the same thing with another girl in our organization.
Respected people, please help me find a suitable solution.
