Sheetal26
Dear Seniors,
Good Morning,
Seeking advise from you.
We have an Employee who is on leave from last more than a month, due to some medical emergency, in this period we have asked him to submit request letter for medical leave along with doctors certificate. but as per doctors certificate he is not fit to attend duty and even for traveling, during his absence there department facing workload which was handled by him, so after discussion with the management we have asked him to take rest and confirm us if he would like to joine back any time in the future atleast before 15 days. so as we are not asking him to leave the Job, and during this perioed he will be on leave without paid. so, could you please tell me during this period do we need to pay his PF ? as i am slightly confused about the same.
looking forward for your valuable feedback.
Thanks.

No need to pay him PF. As per my understanding, your employee is on leave without pay but not on medical leave. If an employee is on medical leave then only he is eligible for PF and salary stuff.
Hope it helps

as per my understanding he is one leave --- weather he is on medical leave or without pay.
he is on your payroll he is not separated from company and responsibility so from employer side contribution should be paid.
i am not aware of legal compliance lets take others views.

Dear Sheetal,
If the employee is getting salary from the company for the medical leave for the sick period, if yes then you have contribute PF and ESIC, if applicable.
If the employee is not getting any salary then contribution to PF is not at all arises.
I hope this will give you clarity.
