Stuck in a Notice Period Nightmare: How Can I Handle This Wrongful Termination?

Hi folks, I have been working in a software MNC for over 3 years. The company enforces a 3-month non-negotiable notice period.

For the past 3 months, I have not been assigned to any project. Due to some unavoidable personal reasons, I have tendered my resignation and intend to leave the job in 2 weeks, but they are unwilling to accept it. I have informed HR via email that I have no pending handovers and I am willing to buy out the remaining notice period, but I have not received a response. Despite mentioning the mental harassment I am facing due to this situation, they insist on the full 90-day notice period.

After 2 weeks, I returned all company property and notified HR via email that I would not be working from the next day. Subsequently, I received a first show cause notice after 2 weeks, to which I responded via email. Then, after 1 week, I received a second show cause notice to which I replied both via email and speed post. In the speed post, I included a cheque for the notice pay amount, requesting my release. However, there was no response.

Six days later, I received a Termination letter citing non-response to the show cause notice and absconding without notice. Interestingly, the same day, the HR department received the speed post containing the cheque. Throughout this period, I have been consistently responding to all their communications, yet they refuse to acknowledge the notice pay.

This situation appears to be a case of wrongful termination. Now, they are demanding full and final settlement by paying the notice pay amount but they are unwilling to provide me with a relieving letter.

What options do I have? It seems they are attempting to damage my career despite accepting my resignation. Please assist.

Hi Friends, I am working as an Assistant Manager with Max Life Insurance. Currently, I am on probation, and my notice period is 15 days. I resigned on August 26, 2013, and my notice period is supposed to end on September 9, 2013. However, my manager, VP, and department head are refusing to release me from the organization. They are threatening not to provide me with the relieving letter and Full & Final settlement. Additionally, they are warning me about potential legal action. My experience and approximately Rs. 70,000 are at stake.

According to my job agreement, 15 days constitute my notice period, which should end on September 9, 2013. Despite this, they are creating obstacles in a dictatorial and illegal manner.

I seek your help and advice on how to resolve this issue.
