Resignation, Notices And Illegal Termination

Hi folks,

I am in a software MNC since 3+ years. The company has 3 months non-buyable notice period.

I am not allocated to any project since 3 months. I have resigned and wish to leave this job in 2 weeks for some unavoidable personal reasons, but they wont accept.

I also dropped an email to HR that I have no handovers pending, and I am ready to buy the remaining notice, but the HR wont reply. They want me to anyhow complete 90 days notice. I also mentioned in the e-mail about mental harassment that I am facing bcoz of this issue.

After 2 weeks, I submitted all the company's property and sent an email to HR that i will not be continuing from tomorrow.

Then After 2 weeks i got 1st show cause notice, to which I replied by e-mail.

Then, After 1 week, i got 2nd show cause notice to which I replied both by e-mail and speed post. (In te speed post I also sent a cheque with notice pay amount requesting them to release me) I got no response.

Then after 6 days I received Termination letter stating that I did not reply to show cause notice and I absconded without any information. (The same day the speed post with cheque was received by HR)

All this time, I was continuously replying all their mails/letters but they wont accept my notice pay

This is a case of terminating an employee on false grounds.

Now they want me to clear the full and final by paying notice pay amount but they wont give me any releiving letter.

What are the options available to me? They are trying to ruin my career even when I resigned and it was accepted.

I am working as a Asst. Manager with Max Life Insurance. Right now I am in Probation and notice period is 15 days. I resigned on 26 August 2013 and my notice period is completing on 9 September 2013. But my manager, VP and department head are not ready to let me out of the organization. They are threatening me to not provide the relieving letter and Full & Final. Not only this, they are also threatening to give legal notice. My experience and around Rs. 70,000 at stake.
As per my letter of Joining (job agreement) 15 days are my notice period that completes on 9 September 2013. Dictatorially & Illegally they are creating obstacles.
Please help me and give my any advice how can I solve this issue
