Not Allowing To Resign Job

Sagar Upadhyay
Hii all.
I am currently doing my job and now i want to resign that job.
I had submitted resign later, but in reply I get as per the company policy you have to work at-list one month and you can not go untill your commitment not finish...
But I want to leave in the end of this month..
Also, there is a one more point, as I was not know about this type of policy, because company still not give me any appoinment later, and I did not sign anything in company.
So can I leave, it?

Dear Sagar,

You can leave the Company at any time, they cannot force you to work, however you should serve your notice period or pay in lieu of notice.

a) If you want your salary and a clean exit then you should offer to resign, serve notice and get relieved.

b) If you have worked in the Company for less then 1 month and you don't want your salary or relieving letter then you can just inform them that you don't want to work there and stop going to your office. - As a HR professional I do not recommend this option, but it's your choice.

From my experience - Whenever I had cases where people wanted to resign immediately after joining, I would recommend to the management to accept the resignation, waive off notice period and relieve the employee immediately . The reason was that in such cases the employee had just joined, not completed training and was not productive, even if the employee would serve notice it would not be of any benefit to the Company.

My recommendation is try to reason with them that you have just joined and you are not fully productive and it would be in the Company's best interest to relieve you immediately.

Hope this helps.

Hi.
Thank you for your reply.
Here are few more details. In this company I had worked more than a one and half year, and given a very nice appreciation. As a software developer some client are also committed that it was nice work, but I am just fade up, because the company owner made some stupidity.
He took away highly recommended project to other developers who are just 3 to 6 month experience, and put me as in a boring project like data entry.
Also company owner not making a salary on time. In generally it is averagely late for 25 days...
Also not paying as enough I am working., so suddenly I made an decision for resign the job. But after his this type of rude reply I feel little bit scare..

Hi Sagar,
I would suggest that you resign, serve notice and get relieved.

It is understood from the above postings and replies that at present you do not have a job on hand and would like to resign due to frustration, so it is advisable to search a good job and serve the notice as per your employer and exit with a clean chit.

A notice of 1 month is standard practice
Even if you have not got the appointment letter, notice period of a month is still valid and required
It's also a fair requirement.

Dear Mr Sagar
Most of the Shops & Est Act provide for such notices e.g. Delhi Shops & Est Act provides for one month notice after three months service. In the absence of any more favorable provision in the appt letter or in the event of no appt letter, this provisions will apply and will be binding.
I do not know place of your work; so I cannot comment specifically; I am giving a general reply.

Dear Mr.Sagar,
There is mentioned in Appointment letter about notice period it means how much period you should work after submission resignation. As per your words you have not signed in any copy.
If you need your salary for worked days and releving documents etc you should complete your notice period and it is the advisable. If you leave the company without serve the notice period you are not expect the salary releving benefits etc..
Thanking You,
Best Regards……

Thank you to all for suggestion.
Also finally my boss made frank conversation with me and we discuss and sot out that for my protect other Jr. developer will be hired and I have to just guide the way of implementation of application, and I agree with this.
Also requested me to complete several complex logic whenever I get time, so no complication made and I agree with this things.
So, finally he understand some of my problem and I agree to finish this project by guiding and provide some complex code, to Jr. developer.
This all with no force.
Well one things is in my mind, IN end of this discussion, he strictly insist me to not leave, in any how. As it was not going to vary smoothly, but I don't know why he insist me to work on all other work, and new project with incremental salary, and all.
