Is It Fair for a Company to Deduct Your Appraisal Increase After You Resign? What Labor Laws Say

mail2mahesh.sinha
Hi HR Team, I worked with an IT organization for 5.7 years. We received an appraisal letter in June, effective from April 2013. Unhappy with the appraisal, I resigned in July 2013 and served my notice period. Now, during the full and final settlement, they deducted the increased amount from my salary. Is this fair, and what labor laws apply to this situation? Attached is my final sheet for reference.

In India, as per labor laws, if an employee resigns after receiving an appraisal but before the effective date of the increase, the company can legally deduct the additional amount from the final settlement. This practice is generally considered fair and lawful. To address this issue, you can try discussing it with the HR department or management to understand the specific reasons for the deduction. If the deduction is in line with company policies and labor laws, it may be challenging to contest. However, seeking clarification and discussing the matter professionally can help you gain insights into the decision and potentially negotiate a resolution.
