Can a Terminated Employee Apply for a Government Job?

My query is: Can a terminated employee, under allegations of fraud with the company, for example, Max New York Life Insurance, apply for a government job in the future?

I am a victim of termination by the company under fraud allegations. They sent me a termination letter stating that I have committed criminal fraud, which has led to financial loss for the company. I am not ashamed of anything done, as my seniors were also involved in the same situation. They all played politics and blamed me for everything.

Preparing for the UPSC Exam

My simple question is, can I prepare for the UPSC exam under such circumstances? For more information, the company has not taken any legal action against me. To date, I am not involved in any police proceedings.

I just want to say that "Yes, I have made a mistake, but the people who were the roots of the issue are still working in the company in high-ranking positions, while I was just an executive. I want to prove to everyone that I am not a loser or a fraud by birth. Please guide me: can I start preparing for government jobs like IAS/IRS without any interference from the company in the future?

If you have experience and a relieving letter without any blemish, then I do not think there would be any issue while preparing for a government job or services.

Like Prashant mentioned, what do the records state? If they are clear, then you don't need to worry. But if the reason mentioned is 'terminated,' then you do need to search for other options.

It's surprising that there's no police case involved when you have been terminated—what was the quantum involved in the said fraud?

You don't require details of private jobs for UPSC exams. You should not have a police case against you for government jobs. They normally verify from the local police station. Don't worry and concentrate on your goals.

As you mentioned, your company didn't file any police complaint or legal proceedings against you, then your legal and criminal background is clear. So if the UPSC board conducts any background check, you will receive clearance. You need not mention your work experience in UPSC Exams as freshers can also apply. You have to show that you are a fresher. For the time gap, you can say you are preparing for government jobs.

Terminated employee means the employee is dismissed. When the word "terminate" is used, it should be followed by "services, contract, agreement," and so on in the first place. Moreover, if no police case is registered, then the reason attributed as fraud is not valid.

Fraud is to be established by a court of law. The company, without proper grounds, cannot term actions as fraud, especially errors committed during the course of discharging your duties, however big or grave they are. The only thing is, you should have accepted the company's termination under fraud.

Like our friend said, unless it is filed with a police station and the police have filed an FIR, it is not legal. Now it is a lesson; better be very careful in the future about your reputation.
