Stuck in a Job Due to Unaccepted Resignation: How Can I Move to My New Opportunity?

Hello HR, I need your help. I have been working in an IT organization for the last two years. In this organization, the notice period is 60 days. I received a better opportunity from a new company and decided to move there. I accepted the new offer and resigned from my current organization, starting to serve the notice period. When I requested my manager to accept my resignation, they replied, "The notice period will start only at the time of the acceptance of resignation. At this point, the resignation is not accepted, as there is no suitable replacement. Once a suitable replacement is found, you will be intimated, and then the process of knowledge transfer, etc., may be initiated. As of now, since your employment status with the organization remains unchanged, we expect you to continue to perform your duties as normal."

I have requested multiple times to all managers and HRs for my resignation acceptance, but they always denied it. I now have only 15 days remaining.

Resignation Challenges in India vs. the UK

I wonder why these days organizations in India trouble staff when they resign to move on! My friends and I had no such problems in changing jobs in the UK. I have done that a few times during my 40 years working in the UK.

Thank you, Simhan! I have gone through the link to which you referred, but I did not find any suitable answer to my query. Could anyone suggest what to do if the company is not accepting resignation and is not ready to relieve?

I am really frustrated here. I did not get any reply on that. What should I do? Do I need to take legal action on it? Please help me with proper solutions.

Are all your correspondences (both your resignation letter and their replies) in writing? If they have not acknowledged your letter, then there is no proof that they have received it. In this case, you should send them another letter explaining your position by SPEED POST. This way, you will have a written record of what has transpired: your request and their responses.

I sincerely hope some experts will answer your query.

I have sent an email to the company GM, HR, and my lead, and I received the reply on that email mentioned below:

“The notice period will start only at the time of the acceptance of resignation. At this point, the resignation is not accepted, as there is no suitable replacement. As of now, since your employment status with the organization remains unchanged, we expect you to continue to perform your duties as normal.”

When I talked with the company CEO on the phone, I mentioned that I received a reply from the GM stating that he is not accepting my resignation, and it is not valuable for me. Could you please help me to accept my resignation and relieve me from my current service after completing the two months' notice period? The company CEO is not in India; he is in the USA, so I can't sit with him and discuss it.

I am now totally confused about what action I can take to get relieved from my current organization.

I have only 10 days remaining to join a new organization. What should I convey to the new organization's HR?

Please inform your new employer of your predicament and ask them for guidance. Also, consider seeking advice from a solicitor.
