I would like to have information on the following:

Industrial Forklift Registration

1. Do we need to have the industrial forklift registered under the Motor Vehicles Act? If so, can I get the relevant act clause number?

Forklift Driver Licensing

2. Do the drivers of forklifts need to have a specific forklift driving license?

Note: I am referring to Karnataka state. Any input in this regard will be highly appreciated.

It is not mandatory to register any vehicle that does not ply on a public road, and the opposite is also applicable. So, if the forklift is never going to leave your private premises, it need not be registered. I have been part of a major litigation wherein the RTO had sued one of the biggest cement companies in Karnataka as they had not registered their dumpers (as they never left the mine area). The company won the litigation ultimately in the Supreme Court of India. But, as far as the license is concerned, the driver needs to have the required license for operating a forklift. No registration is required. However, the forklift driver needs a driving license, and they should be trained.

If anything goes wrong, both the owner and the driver are responsible for liability.

For the safety of the company and insurance purposes, it is better to have the forklift registered with the RTO. The forklift driver should possess a valid RTO license issued by the RTO. Finally, the principal employer where forklift services are used is responsible.

Yes, it needs to be registered under non-transportation vehicles. If I am not mistaken, it is referred to in the Rules and not in the Act. I also suggest you refer to the rto.kar.nic.in and also the Transport Department - Govt. of Karnataka (link updated to site home) (Search On Cite | Search On Google) for more accurate details.

In rto.kar.nic.in, you will have the facility to ask questions. There must be a separate page for that.

Karnataka motor vehicle taxation speaks of the same. If such vehicles are not registered, how do you expect the tax to be raised?

Forklift Registration Requirements

For your kind information, yes, we have to register forklift machines. It comes under Section 2 of the CA MVA. We have to pay a life tax amount for forklifts, which is calculated by the total value of the machine (including customs charges) multiplied by 7.5%. The registration fees are $5000.

Note: If you fail to pay the life tax amount, a 2% penalty is applicable, i.e., it will be calculated from the life tax amount.

My query is whether forklifts require payment of any road tax.

I have purchased a new forklift. Is there any guidance available for registering the lift in AP? Kindly advise as the head office is requesting these details for registration.
