How Can Our BPO Legally Operate on Independence Day Under Essential Services?

Hi, I work as an HR professional in a BPO company, and we will need to work on Independence Day. What document or letter do we need to obtain from the government or under the TN Shop and Establishments Act to work on that day as we fall under "Essential Services"?

In the event that we fail to comply or obtain it before the specified date (August 15), what legal implications would we face?

Please assist us on how to proceed.

Thank you very much for your reply. Anyhow, we are declaring an alternate day off for the employees, but just want to understand the legal implications that come with regards to labor and welfare relations.

I believe your establishment is registered under the Shop and Establishments Act. There, you might have mentioned the nature of the business you are engaged in as an essential service, and holidays will be observed on a rotational basis.

We usually engage the minimum number of employees on national holidays, and we offer the option to either take leave or receive double the salary for the day.
