Understanding Leave Days: How Do Monday and Tuesday Off Affect Your Count?

If we take MONDAY & TUESDAY OFF after the fifth Saturday and Sunday, how many leave days will be counted? 4 or 2?

If your company is paying for 30/31 days of salary, then your week off (Sunday) is a paid week off. In this case, if you are present on Saturday and take leave on Monday and Tuesday, it will be considered a two-day leave. However, if you are absent on Saturday and take leave on Monday and Tuesday, then it will be a three-day leave.

If your company pays salary for 26 days by deducting the 4 weekly offs in a month, then even if you are present on Saturday and take leave on Monday and Tuesday, it will still be a two-day leave since your weekly offs are not paid.

The leave allowed to an employee under clauses (a) and (b) shall be inclusive of the day or days during the period of such leave, on which a shop or commercial establishment remains closed under sub-section (1) of section 18, or on which they are entitled to a holiday under sub-section (1) of section 24 or section 31.

This clearly means that if your Saturday is a working day, and you took leaves on Saturday, Monday, and Tuesday, your leaves to be counted shall be Saturday-Sunday-Monday-Tuesday, i.e., 4 days. I hope this clears your doubts.

If, however, you work 5 days a week and Saturday-Sunday are weekly offs, in such cases, Monday-Tuesday will be a 2-day leave. Hope your doubt was clarified.
