Handling Resignations Without Notice Period

If a person resigns and is unable to serve the notice period, what action do we take? If the person is out of the city and unable to come back to serve the notice period, how do we close the issue? Especially if that person has spent a couple of years in service at the same company, do we close it on humanitarian grounds?

What happened exactly? Was there an accident or something that prevented him from coming back to the city? Unless you provide details of the case, how can we determine if it's a genuine concern? If it is, then please proceed with the FnF settlement of the employee.

Please let us know the terms and conditions mentioned in the appointment letter pertaining to the termination of employment by either party. Also, if the appointment letter mentions that salary can be paid in lieu of the notice period, you can go ahead and deduct salary for the notice period that is not served by the employee.

Please discuss with your management, and if the management decides to waive the notice period, then proceed accordingly. If the management wants the employee to compensate for the notice period, follow that course of action. No law prohibits waiving the notice period if the management chooses to do so.

In my opinion, the "Notice Period" is only an agreement or understanding between the employer and employee. If an employee serves well in the company and leaves or resigns from the job due to unavoidable circumstances, the company's management can consider and relieve him under normal circumstances without imposing any penalty.

If the employee's reporting manager waives off his notice period, then he can be relieved from the services the day he submitted his resignation letter.

If the employee's reason is genuine, the resignation can be accepted, and his Full and Final settlement can be closed as soon as possible.
