Resignation Issues

Hi All,
If a person resigns and is unable to serve notice period, what action do we take.
If the person is out of the city and unable to come back to serve the notice period, how do we close the issue. especially if that person has spent couple of years service at the same company, do we close it on humanitarian grounds.

what happened exactly some accident / something which forbid him from coming back to city, unless you mention the case how do we know if it is some really genuine concern then please do FnFsettlement of the employee.

Dear Sir,
Please let us know the terms and conditions mentioned in the appoointment letter pertaining to termination of employment by either parties.
As also if the appointment letter mentions that salary can be paid in lieu of notice period you can go ahead and deduct salary for the notice period that is not served by the employee.

Please discuss with your management and if the management feels to waive off the Notice period then go ahead. If the management wants the employee to pay for the notice do accordingly. No Law prohibits anyone to waive off the Notice Period if the Management desires so.

In my opinion - "Notice Period' is only an agreement / understanding between the Employer and Employee
Any employee serves well to the Company and leaves/resigns the job under unavoidable circumstances
the Company's Management can consider and relive him under normal course and without imposing any penalty.

Dear KR,
If the employee Reporting manager is waived off his notice period then he can be relieved from the services the day he submitted his resignation letter.
If the employee reason is genuine, resignation can be accepted & can close his F & F ASAP.
