Infancy Protection Under the PF Act

Under the infancy protection, the Act was not applicable for establishments employing 50 or more persons, up to a period of three years from the date of setup. Infancy of five years was allowed in the case of establishments employing twenty or more persons but less than 50 persons. This period was called the infancy period under the PF Act.

However, effective 22-9-1997, this infancy period has been dispensed with, and all establishments employing 20 or more persons are brought under the purview of the Act from the very date of setup, subject to the fulfillment of other conditions.

You quoted that "However, effective 22-9-1997, this infancy period has been dispensed with, and all the establishments employing 20 or more persons are brought under the purview of the Act from the very date of setup subject to fulfillment of other conditions." What are the other conditions? Should we pay the monthly contribution up to 3/5 years?

Thank you for your reply. What are the other conditions? Should we pay the monthly contribution for up to 3 to 5 years?

Conditions for Establishment Coverage

There are just two conditions:

1. The establishment must be within the purview of the notified industry. Today, most industries are notified; I could not recall offhand which industry is not notified.
2. The coverage commences on the day it starts engaging 20 employees. Of course, it is optional for the Management to commence earlier.
