Resigned From Organization But Not Accepted By Company

Dear All,

I have submitted my resignation as per the company's policy. I have served my one-month notice period, but until now, the company has not released me from my services, and I have to join a new organization. My current company is forcing me to continue my services for an additional month. If I comply with my current company's request, I will lose the new job offer. I am seeking guidance from you on this matter.

How did you submit your resignation? Was the letter acknowledged? Do you have any proof that they received your resignation letter?

Also, kindly provide as much information as possible about how long you have worked for the company, in what capacity, etc.

Your resignation needs to be accepted by the management of your company for your relieving. You have explained that you have resigned and served one month notice. The below queries are still unanswered:

1. What was the mode of your resignation?
2. Whether the company has acknowledged and accepted your resignation or not?
3. Do you have a copy of your resignation (duly signed by HR as a token of receipt; if the resignation was not submitted through email)?
4. What is the required notice period as per the appointment letter?
5. What is your designation in that organization and what type of assignment were you taking care of?

What was the mode of your resignation? I had sent my resignation through mail. I received a reply from my MD after 20 days stating that we will discuss the matter one-on-one. They have not acknowledged or accepted my resignation. I have sent a reminder to the GM HR, but there has been no response. As per my appointment letter, I have to give one month's notice period, and my designation is Executive A & R.

I am taking care of administration work and assisting the Managing Director.

Reply from your MD is itself the acknowledgment of your resignation. Talk to your MD & HR first and explain your situation. If the matter is not being resolved, then send an email to your management in reply to the MD's email, mentioning that you have resigned from your services as per company policy and followed the proper notice period as mentioned in clause no. xx in the appointment letter. You are legally eligible for all the employment benefits and proper relieving. Hope the company will accept your resignation.

If they are creating some problem in your relieving, you can explain your situation to your new employer at a later stage. Keep the printouts of all communication regarding your resignation for proof if needed.

Dear Pravin,

Having tendered your resignation and the Managing Director insisting you to serve one month more, please have a one-on-one frank talk with him stating that you have resigned from the company as per the rules and that you wouldn't like to leave without a proper release. In case he has some specific problem, say that you are prepared to abide by his desire provided he agrees to write to your prospective employer about the date of your release, and until then, they should keep your offer of appointment valid. Should he agree, please write to your prospective employer through the present one about your date of release and request them to keep your offer open until then. I am sure your problem shall be sorted out.
