How Can I Handle My Boss Refusing to Accept My Resignation in Bangalore?

I am working as a production manager for one of the manufacturing companies in Bangalore since 2008. I submitted my resignation two days ago, and I am reporting to the managing director. However, he is not accepting my resignation and is refusing to release me. As per the employment agreement, I need to serve a one-month notice period, which I am ready to serve, but he is not agreeing to relieve me. I am also not getting any response from the HR department since the HR department comes under him. Please help and guide me to overcome this situation.

Let's look at your situation from a different angle.

1. Why did you resign? Was it for better prospects (designation and/or salary), or did you have any problems/issues in the company that forced you to look outside?

2. What were the reasons the MD gave to refuse acceptance?

If your resignation was purely for better career prospects and you didn't have any problems with the MD or others in the company, and your MD doesn't want to let you go since he thinks that you are too valuable, maybe you can cut a 'deal' with your MD? Just give this a thought.

Dear TS, Thank you for your reply. Actually, the problem is our MD is a difficult person, and he expects us to work long hours, resulting in us working around a minimum of 60 hours per week. He does not consider our personal problems. Additionally, we do not receive any fringe benefits, including provident fund contributions, which are only paid at the minimum cap.

Given his character, if I were to reconsider my decision, I am 100% sure he will cause trouble for me in the future. Therefore, I have lost interest in continuing my services. Please suggest how I can address this issue with the relieving letter.

In case you have sent the resignation through email, list down all your activities in a handover format. On the last day, send him an email with details of the handover and state in the email with reference to the resignation letter that you have served the requisite notice period and to send your relieving and settlement to you. Since you say that it's an unorganized organization, I doubt whether the settlement or relieving order will come. But, have copies of emails in which your resignation is mentioned and also note the last date of working and keep it as a record.

Nothing much can be done when you have such difficult and unpredictable people as the MD. All the best.
