Seeking Advice on PF Number Allotment and Remittance Delays: What Are the Legal Implications?

Dear seniors, I need your help regarding some doubts on PF.

PF Number Allotment for New Employees

1) If a new employee joins the organization, e.g., DOJ is 22-06-2013, when do I have to allot a PF number to him?

Delayed PF Number Allotment

2) If PF numbers are allotted 3 months or more after their DOJ for some employees, are there any chances for corrections or any punishments as per the law?

Missed PF Remittance

3) If PF remittance for some employees is eventually forgotten to be submitted for 6 months or more, what are the procedures or punishments?

Query No. 1: As and when an employee joins your organization, you have to allot the PF number.

Query No. 2: You can pay now; no punishment applies.

Query No. 3: You can remit the amounts without any fine.

Regarding PF Joining Date and Penalties

If you mentioned the PF joining date as the actual date and pay PF after 3 months, then indeed a fine has to be paid as mentioned in the PF Act. Please refer to the specific provisions for detailed guidance.

1) PF Number Allotment After 6 Months of Joining

i) If it differs from the actual Date of Joining (DOJ), what happens? Can I make any corrections, or do I have to face any punishments?

ii) If both the actual and PF DOJ are the same, what happens?

2) Forgetting PF Remittance for 10 Employees

If I forgot to submit PF remittance for 10 employees for 6 months or more, what are the procedures? Are there any fines or punishments I have to face?

Please allot PF numbers serially in ascending order according to the chronological order of the Date of Joining for services. The Date of Joining for services and PF member joining should be the same. PF deductions must be made as per the rules effective from the date of joining. Do not make any corrections to the date of joining in both the organization as well as PF records.

Avoid late payments. If due to any issues, payment is delayed, your organization should pay interest and damages as per PF rules. Don't forget the remittance for the 6-month period for 10 employees, as your HR person is currently submitting PF online.

As per my best knowledge, your queries can be addressed as follows:

1) If a PF number is allotted after 6 months of joining, meaning the PF eligibility was after 6 months of the employee joining, there shouldn't be a problem. You can pay the PF remittance from the applicability date, even if the joining date is 6 months earlier.

2) If the DOJ is after the PF applicability date, then the DOJ should be the same as the actual joining date. In this case, nothing happens; just pay the PF from the DOJ of the said employee.

3) If you forgot to submit the PF remittance, pay it now with interest and penalties if applicable.

I hope I have cleared your doubts.
