Navigating Sudden Termination: Can I Challenge My Firing and Seek Justice?

Dear Seniors,

I joined a Pvt Ltd software company as a Sr. HR Executive on June 5th. Due to this job, I relocated from Chennai to Trichy. After one week of joining, they sent me to the Chennai head office for an induction program. At the end of the week, they gave me a termination notice without any prior warning or notice. I argued with them and asked for the reason. They told me that my performance was not satisfactory and that I did not meet or ask the department head about the induction program. They terminated me immediately that day without a notice period.

My Questions

1. What is induction? What purpose does induction serve for new joiners?
2. Should the induction program be requested by new joiners from the employer, or is it the employer's responsibility to provide it to new joiners?
3. Can a new joiner be terminated within a month without any warning or notice?
4. How can I claim my losses?
5. Is it possible to apply to the labor court?

You have joined as a senior HR executive, so you ought to know the basics. Induction is the familiarization process for new joiners with the organization, people, systems, and processes. It is a necessity for both the company and the employee.

Termination and Performance

The company can terminate your services on the grounds of "non-satisfactory performance" by issuing proper notice and complying with the related clauses as agreed in the appointment letter. A professional company would not terminate at such an early stage as you have not yet taken charge and assumed the roles and responsibilities you were hired for.

Possible Reasons for Termination

There may be other reasons such as:
1) The company might have made wrong recruitment decisions - untimely or unsuitable, or a later-stage development resulting in untimely recruitment.
OR
2) You may need to do genuine introspection - Did you make a grave mistake like hiding facts, etc.?

Do not get disheartened. Request the company if, instead of termination, they would accept your resignation.

I agree with Mr. Shailesh Parikh. Try to have introspection and, with a cool mind, try to find out why they terminated your services within the induction course period. The labor court is not the place for someone like you. Get in touch with the company and try to sort out the matter.
