Factories Act - can an employer insist every worker that by rotation have to work during night shift?

Dear ilangovan,
Factory Act permits for working in all three shifts including night shift. We need to ensure that there is equal shift rotaion of employees and accordingly shift schdule has to be made in the prescribed FORM as stated in the state rule. This form has to be displayed on the notice board for information to employees and union.
Employees not following shift schedule will be treated insubordination as per the provisons of Standing order Act.
There is no provision of paying night shift allowance in Factories Act 1948.
However, calculation of wages in Night Shift working Section 57 of Factories Act will apply.

Dear Kamal Nain,
Please read Factories Act, 1948 Chap-VI - Working Hours of Adults. Overall working hours should not 48 hours a week. Exemptions are there and exercised by respective State governments and Factories Dept. officials.

Hi,
Under the Contract Labour Act (Karnataka Rules 1974), progressive and mandatory guidelines (on women’s employment during night shifts) have been passed, which is applicable to all factories, establishments, IT and BT sectors. Check out the link for more info:
