Navigating Contractual Employment: Are You Entitled to Payslips and Legal Documents?

I am working with the Gujarat government department on an 11-month contract basis. I joined a couple of months ago and currently hold a leading position. I have some questions regarding my payslip, joining letter, Form 16, etc.

Questions Regarding Contractual Employment

1) Are employees who join under this 11-month contract considered under the Contract Labour Act 1970, or are they covered by any other act?

2) Are individuals who join under this 11-month contract eligible to receive a joining letter, Form 16, and payslip?

3) Should this 11-month contract be prepared on a stamp (legal) paper or on simple paper?

Kindly provide guidance on the above matters.

Answers to your questions serial-wise are as follows:

1. You are not a contract laborer since, it seems to me, your employment is direct with the department and not through any agency. This kind of appointment is contractual for a Fixed Term.

2. This kind of employment is also eligible for a joining/appointment letter, Form 16 under the Income Tax Act if your taxable income is in the IT bracket. It is also eligible for a payslip.

3. The contract paper/appointment letter does not need to be on stamp paper.
