Hello, my name is Tushar. I am working in South Africa, and I'm under a contract for three years. According to the contract, if I complete my service period of more than 1 year but less than 2 years, I have to pay my ticket and all expenses. However, if I complete the service period of more than 2 years but less than 3 years, then I only have to pay the remaining visa charges. Now, I have submitted my resignation 10 days before completing my 2 years of service, but I have a 1-month notice period. I am unsure which terms I will fall under. Please let me know because I am a bit confused.

Couldn't you have waited for 10 days before resigning? You should have asked this query BEFORE you resigned. USUALLY, the notice period is not counted as part of the contract period, but it also depends on how the employer interprets this clause. I am not sure about South African laws—meaning how strong they are in protecting employee interests. I guess you need to keep your fingers crossed and hope for the best.

Calculate the start and end day in the organization irrespective of when you have submitted your resignation letter. For example, if you have resigned now but are leaving the job after one month, and if this completes your two years of employment, it will be considered as leaving after two years.

Additionally, check your contract to see if it specifies anything about resignation, such as whether the notice period is a part of the contract terms or not. Logically, it should be a part of the contractual period only.
