Navigating Probation Resignation: Will My Friend Get Paid for His Notice Period?

My friend, who was under probation, started on November 21, 2012, but he submitted his resignation letter on April 27, 2013. He was advised by his employer to work until May 27, 2013, even though it was within the one-month notice period as required by the company. The last salary he received was on April 25, 2013.

Probation Period and Company Policy

The offer letter states that an employee under probation who is terminated or does not complete the probation period will be required to pay for the expenses incurred by the company for processing the working visa and other related costs. The probation period is six months. The question is, did he complete the full six-month period based on the specified dates?

Salary Payment During Notice Period

Will the company pay him for the period he worked within his one-month notice period from April to May?

Total Working Days: 6 months 6 days.

This means that before the end of probation, the employee resigned, thereby terminating the contract and triggering the "Penalty Clause." According to the Qatar Labor Act, the employee must be paid for all the days he worked. However, the employer, as per the contract, has the right to deduct from his full and final settlement the agreed-upon dues.

As per the joining and resignation dates, your friend has been tenured for 5 months and 6 days. Usually, the probation period was for 6 months. However, as per the instructions of the management, your friend has worked for an additional month of probation, completing a total of 6 months and 6 days. There is no rule mentioned in the company's policies that your friend shouldn't resign while in probation, and no penalty is levied for a resignation during this period.

The company will pay for the total number of working days completed by the employee. Please advise your friend to complete the exit formalities along with the full and final settlement by the employer.

We appreciate your reply and thank you for sharing. He worked for 6 months and 6 days; does it mean he completed almost his probationary period then?

Any idea of how much the company will deduct for said dues, and how many days will my friend be able to stay here in Qatar while he's waiting for a call or email from the company HR processing his documents to exit Qatar? How long will he be banned in Qatar?
