Please note that due to misbehavior and unethical approaches by the management, I left the organization in August 2013 after working for more than a year in that Group of Company, which is still running under ROC registration without having registration under the Shop and Establishment Act, WB.
When I left the organization, I kept the laptop, which is the asset of the company, with me. I clearly mentioned in an email to HR that once all my dues (bills and reimbursement) and salary are cleared, the asset will be handed over to the Siliguri office (my base branch office as per the appointment letter given by the concerned HR).
However, HR has replied to my email stating that I have to visit the Head Office in Kolkata for full and final settlement. Unless I do so, nothing will happen...
My Queries
1. As it was not mentioned in the appointment letter that for full and final settlement the employee will need to sit with HR at the Head Office in Kolkata, am I bound to visit the Head Office for full and final settlement? What if I don't visit the Head Office? Will they take any legal action against me as per labor laws/regulations?
2. If I wish to join another company, will they accept the resignation which I submitted via email without having acceptance from the company's end?
3. HR has said to visit the Head Office, and only after that will they proceed further. If I don't visit their Head Office and only communicate via email, will it be harmful to my career? Could this situation become critical?
Also, please suggest how long such cases can remain open-ended. Is there a specific time frame to close such cases? Can I keep the laptop with me indefinitely?
