Regarding Provident Fund Not Getting Deducted

I have newly joined onc IT consultancy where PF is not getting deducted & i getting paid basis above Rs:6000/-& i just got to know about from 11 under EPF act does it necessary me to fill the form 11 & also my company has still not enforced the EPF laws.Please clarify my query whether i should fill the form 16 or not.

If your company is not covered under the EPF Act you will not get the benefit of EPF and EPS. Your company will be covered under the EPF Act only if it fulfils the conditions mentioned in the Act for coverage of establishments. You have to get this aspect clarified from your company whether the company is coverable under the EPF Act. If yes, then you should find our why it is not implementing the provisions of the Act. If no, the question of you getting the EPF benefits does not arise.

Your query is vague and contradictory.
I think you have got some things mixed up.
I assume that your company is not deducting and depositing PF. If they have more than 19 employees then PF is required to be deducted and paid. However, any employee who is getting a starting salary of more than 6500 per month (basic + da) and who does not have an existing pf account can be exempt. Fr that, the employee has to apply to the company for exemption. The application is in form 11
Since your employer does not want to be burdened with PF, they are making all employees apply for exemption. If the above situation is correct, you do not have an option but to fill up the form 11. Else you may quickly find your self looking for another job. However, do not fill the form if you have an existing PF account from a previous employer.
