Facing Months Without Pay and Now Pressured to Resign – What Are My Legal Options?

I have been working in a Ltd company since September 2012. The company started paying half my salary until December 2012. From January 2013, the company stopped paying my salary entirely up to the time of writing this. I had a severe accident while on duty, but the company did not pay any amount against the balance salary for hospital treatment. During November 2012 to January 2013, my reporting manager marked me absent without reason. Now, I am inquiring about when the salary will be paid to HR and accounts, but I am getting the response that they don't know. It is known only by the CMD.

Meanwhile, on May 1, 2013, the CEO sent an email to everyone stating that during this month, i.e., May 2013, all the balance salary would be paid. However, to date, not a single rupee has been received, and the management is asking me to resign from my duty, promising that all dues will be paid after three months. How can we believe this? Is there any legal way to solve this problem? Please reply.

As per your query, you need to clarify one thing: did management issue any appointment letter or not? I'm wondering how you worked nine months in the organization without being paid salaries. If management issued the appointment letter, you can directly approach the concerned Labour Department Officer and file a written complaint against the management regarding your unpaid salaries. Management has no right to ask for resignation without proper reason. If they want to ask for resignation, they should provide one month's notice or one month's salary as per your appointment letter.

Management issued the appointment letter to me, stating the work location as Aurangabad, Maharashtra, on 9/1/2012. I contacted the Aurangabad Labour department/officer, but they replied that the company is based in Ahmedabad, Gujarat; hence, this matter does not fall under our jurisdiction.

Afterwards, I reached out to the Labour Court, but when issuing the notice to the employer, the judge objected, asking, "If we issue the notice, how will we enforce it?" Currently, the advocate has been working on addressing the objection for the past 7-8 days, but no positive outcome has been achieved.

Therefore, I am requesting your guidance or suggestions on this matter. Please assist me if you have any advice.
