Minimum Wage Confusion: Should We Follow Central or State Rates for Telecom Services?

Gaurav Parasar
We, as a company, are under scheduled employment and providing services to a telecom company. Could someone please guide me regarding the applicability rate of MW (central rate or State rate)?

Please visit the website paycheck.in where you will find the rates of wages under the Minimum Wages Act for all States and the Central Government.

I would like to know which rate will be applicable in this case, the Central rate of wages or the State rate of wages?

If your company is a private company operating only in one state, you will be governed by the minimum wage rates declared by that state. However, if your company operates in multiple states, the appropriate government authority shall be the Central Government. The higher of the minimum wage rates set by either the central government or the particular state of establishment for the specific scheduled employment shall be applicable.

Dear Gaurav,

Please note that as a contractor, you should always check the following:

1. Who is the appropriate government for your principal employer - the Central government or the State government.
2. If it's the State, then you have to follow the State Minimum Wage (MW); otherwise, it's the Central MW.

Therefore, kindly check whether telecom companies are under the Central or State Government's ambit.

Regards
