Maternity Leave Payment: How Should Companies Handle Salaries for Non-ESIC Employees?

vandita sawhney
I need your help. Suppose an employee who does not fall under ESIC goes on maternity leave. Kindly let me know the procedure for maternity payment/salary. Does the company have to pay for 3 months as per the Factory Act?

Looking forward to your reply.

A woman worker shall be entitled to maternity benefits if she has worked for 80 days or more during the preceding 12 months; otherwise, the employer is not responsible.

Thank you.

If a woman employee is not covered by ESIC, she can claim maternity benefits under the Maternity Benefit Act of 1961 for 12 weeks, provided she has completed a minimum of 80 days of service in the 12 months preceding the expected date of delivery.
