Legal Classification Confusion: Is My Pharmaceutical Company a Factory or a Shop?

Respected Seniors,

I am working in a pharmaceutical company in New Delhi. My company buys medicine from another company under its name. The company has recently registered with ESIC and PF.

Legal Classification Inquiry

I want to know under which act my company falls, i.e., the Factory Act or the Shops and Establishment Act, etc.

I will be so thankful for your help.

From your question, I presume you are a trading firm; hence, you would come under the Shops Act.

Yours is not a manufacturing company, nor any hospital, hotel, educational institution, railway, etc. So, the presumption of it being a trading/marketing firm appears to be correct.
