Statutory Compliance Confusion: Which Act Covers White-Collar Employees in Trading Firms?

Dear Fellow HR Compatriots,

Query Regarding Statutory Compliance for Employees

I have a query. Under which act are white-collar employees of a trading company covered with respect to statutory compliance such as PF, LWF, leave encashment, and leave carry forward - the Labor Act or the Contract Act?

I look forward to some useful advice on the subject.

Cheers,

PF is different from other acts. PF for all employees is irrespective of the nature of the organization and is covered under the PF Act. Others like LWF, Leave Encashment, and Leave Carry Forward are controlled by the Shops & Commercial Act or the Factories Act based on the registration.

If you are engaging any contract employees/contract laborers, then the Contract Labour Act comes into the picture. If you want to engage any contract laborers, you should get approval from the labor commissioner.
