What to Do If Your Employer Is Not Providing Form 16?

Is there any other option to get your Form 16 to file your Income Tax Return (ITR)? At the same time, what is the procedure?

Tax Deduction at Source and Form 16

If there is a tax deduction at source, it means that if the company has deducted any tax from your salary, the company is bound to issue Form 16. However, if there is no deduction at all, the company is not bound to issue Form 16.

If any employer is not providing you with Form 16A in the case of TDS deduction in salary, you can register a complaint against the employer with the help of the Labour Court. The Labour Court will take action against the problem.

The issue of FORM 16 is governed by the Income Tax Act and not by any labor/employment-related acts. The concerned government authority in this matter is the Ward ITO or Assistant Commissioner of Income Tax and not the labor court/officials. Please don't post wrong information.
