Eligibility For Gratuity - Family Problem

Dear All,
My friend working with one of the reputed ltd. company from last 4.10 year But due to Family problem last Three month he had taken Leave & LWP (Leave Without pay) so please confirm to me his eligibility for Gratuity.

please elaborate little more as what is date of jpoining whether resigned or not .if resigned than date of resignation.

Date of Joining 02-07-2008 & He is not resignation on Job. But the same time he on Leave (LWP)

Dear Mr. Snlahamge,
you posted your thread dated on 07-April-2013, and you friend has been joined dated on 02-July-2008 as per you,after calculation it is 4 Years 9 Months and 5 days, One become eligible for gratuity after completion of 5 years of service.
So, he is not eligible for gratuity .

as per my concern in some court cases we have find that the gratuity also paid to employee if he completed 4 years & 240 days of service.
