Is My Friend Eligible for Gratuity After Taking Leave Without Pay? Seeking Advice

My friend has been working with one of the reputed limited companies for the past 4.10 years. However, due to family problems in the last three months, he has taken leave and LWP (Leave Without Pay). Could you please confirm his eligibility for Gratuity?

He has not resigned from the job. Currently, he is on leave without pay (LWP).

Dear Mr. Snlahamge, you posted your thread dated 07-April-2013, and your friend joined on 02-July-2008 as per your information. After calculation, it is 4 years, 9 months, and 5 days. One becomes eligible for gratuity after completion of 5 years of service. Therefore, he is not eligible for gratuity.

Regarding my concern, in some court cases, we have found that gratuity is also paid to an employee if they have completed 4 years and 240 days of service.
