ESI Benefit For Parents After Marriage????????????

Hi everyone,

One of my colleague's doubts is whether her parents can be covered under ESI benefits. Her husband has already covered his parents. They all reside together, and her parents are dependent on her.

Could you please guide me on this? Is there any specific clause for this situation?

I think she can cover her parents as well. ESIC doesn't allow siblings for coverage, but parents are allowed since she is married. I'm not sure about the same.

Dependent parents are eligible to get benefits under the ESI Act as they come under the definition of family under Section 2, Subsection 11 of the Act. In case of any queries, please contact me.

I too know that. But as she is married, do her parents still come under Dependents? In the section, it is mentioned only Dependent Parents. It is not clear about my doubts.

If the parents of the employee, whether married or unmarried, are fully dependent on him, they come under the definition of family and are entitled to get medical benefits. The only question is that they should be dependent on him, nothing else. For more information, you can contact the ESI office. There is no more clarification in the ESI Act itself.

You are right, the clause states that if parents are dependents of the earnings of the insured employee, the said parents are covered under the ESI Act for the purpose of extending medical benefits.

I have the answer to your question. Even a married woman can cover her dependent parents. I have clarified this with the ESI manager. According to him, parents of both men and women are covered under ESI if they are dependents. Importantly, the marriage factor does not come into the picture.

As per legal terminology, the term "dependent" means any person who depends on another for his or her basic needs and wants. In your case, the employee can provide ESIC benefits to her parents as they are dependant on her. However, as far as her husband is concerned, under no law of India to this date has the husband been seen as a dependent on his wife. Indian society is very clear that the husband is the provider, and the responsibility of caring for the wife lies with the husband, not vice versa. Therefore, please advise your employee to proceed accordingly.

In Form ESIC-105, can a husband be declared as a dependent? Can parents-in-law also be shown as dependents?

Is it from day 1 of joining, or is there a specific period like months of employment, 6 months, or 2 years?
