Hi, please tell me the total count of holidays and the number of leaves to be given to an employee in an organization. Does it differ from organization to organization? If yes, please let me know the minimum count at least.

As per the AP Shops and Establishment Act, there should be a minimum of 10 declared holidays other than weekends.

Regarding leaves, every employee should receive 1 Earned Leave (EL) for every 20 days worked, and 10 Casual Leave/Medical Leave (CL/ML) is mandatory.

It varies from organization to organization, but as per the Factory Act of 1948, after the completion of 240 days, an employee is entitled to 15 leaves. This will consist of 1 Earned Leave (EL) after 20 days, and 7 Sick Leaves (SL) and 7 Casual Leaves (CL).

The number of holidays or leaves differs from company to company and is mostly based on its policies. Though most companies follow this leave structure:

- **Medical or Casual Leaves:** 10 Days in a year (Minimum)
- **Annual or Earned Leave (EL):** 1 EL for every 20 working days

There is no provision for CL and SL under the Factories Act 1948, Mines Act 1950, or Plantation Act 1951. However, under its own certified Standing Orders, the company has to provide for CL as well as SL. There is no Central Shop & Establishment Act. Under specific State Shops & Establishment Acts, there is a provision for providing EL, CL, and SL or CL cum SL.

First, holidays are different from leaves. In our country, national holidays are on August 15th, January 26th, and October 2nd, etc. State-wise holidays vary from one state to another.

Organizations may be registered under different acts such as the Factories Act, Companies Act, Mines Act, Shops and Establishment Acts, etc. Depending on the various acts, the policies differ.

Types of Leaves

Generally, leaves come in many types:

- CLs: 12 CLs not carry forward.
- SLs: 12 SLs.
- ELs: 12 ELs carry forward, and they can be encashed. This is also called privilege leaves.

Maternity leaves are for 90 days for women. They can use 45 days before pregnancy and 45 days after pregnancy, as of the delivery date.

Maternity leaves are 180 days for central government employees covered under GOI. Maternal leaves are also available for women who experience a miscarriage.

Yes, indeed, the number of holidays and leaves varies from organization to organization. It is the management, along with HR, who decide how many leaves an employee should get in a year. The number of leaves also varies between employees of the same organization; it's all management policies that can't change overnight. A lot of things are taken into consideration. Moreover, a marketing personnel gets more leave than a back-office employee because of the different nature of work. Similarly, this applies to all other departments of an organization.

From which country are you? If you are in a government job, then leave is based on local festivals. If you are working for a foreign firm, it is based on their important dates and your country's important dates when leave is decided.
