How Many Casual and Earned Leaves for Employees Based on Their Joining Date?

How many CL and EL are allowed in one year for an employee who joined three years ago? For instance, if an employee started in January 2012 and worked 192 days until December 2012, how many CL and EL can be allocated?

In a separate scenario, if an employee began on 1st August 2012 and worked 80 days until December 2012, how many CL and EL should be provided?

Understanding Leave Policies: CL, SL, and Earned Leave

There is no constant rule for CL (Casual Leave), SL (Sick Leave), and Earned Leave applicability. Different companies follow different rules. However, please refer to the model standing orders of your company, which will help you obtain further information.

Normally, companies provide 6 CL and 6 SL per calendar year. If anyone joins in between, it will be calculated on a pro-rata basis. For the workmen category, for the first 180 days, 1 PL (Privilege Leave) is granted per 16 days of working (i.e., 15 PL for the first 180 days) and further 1 PL per 10 working days. All leave calculations are based on the calendar year.

Clarification on Leave Policies

Greetings for the day,

CL, EL/PL, and SL are well defined under the Factory Act, Shop & Establishment Act, and also in the Negotiable Instrument Act. There are no different rules for different companies. Companies can only provide the same as per norms defined:

1. CL - Not less than 7 and can be calculated on a pro-rata basis, can't be carried forward to the next calendar year.

2. SL - Not less than 7 and can be calculated on a pro-rata basis, can't be carried forward to the next calendar year.

3. EL/PL - Should be 15 in a year, 1 for every 20 working days, can only be availed after continuous working of 240 days, and shall also be carried forward to the next calendar year.

This leave policy depends on the company policy. Generally, the company will provide 12 CL and 8 ML, and EL (Earned Leave) based on the total working days. Some companies will also offer PL, which depends on the number of working days.

Leave Calculation Details

CL and SL are 1/2 for a month, while EL/PL are 1.75 per month. Calculate and allow him. CL and SL are not carried forward, but depending on management, SL can be carried forward up to February next year only.

If you are covered under the Factories Act, then Casual Leave (CL) should be a minimum of 7 days a year, and Earned Leave (EL) is calculated at 1 day for every 20 days actually worked. In a year, after accounting for weekly offs and festival holidays, the actual number of workdays would be about 300. If the concerned person has attended all the 300 days, then they would be eligible for EL of 15 days, which can be availed the subsequent year.

Mr. Sanjay has not mentioned the nature and type of his firm. If it's a commercial one, follow the Shops and Commercial Establishments Act of the state. If it is a factory, please note that it does not prescribe Casual Leave. The Negotiable Instruments Act does not allow for casual leave in any establishment.

How many CL & EL in one year?

Answer:
- CL: 7
- EL: For 20 days - 1 day as EL (minimum working days required is 240 in a year to be eligible for EL).

Scenario 1: Employee Joined Before Three Years

From Jan. 2012 to Dec. 2012, his working days were 192. How many CL & EL should the employee receive?

Answer: He is only eligible for CL, not for EL, as he does not have the required number of working days for EL eligibility.

Scenario 2: Employee Joined on 01.08.12

How many CL & EL should be given to him until Dec. 2012, considering his working days were 80?

Answer: He is eligible for CL only as per your company policy, but not for EL during that period.

Dear Mr. Guru_Home, I think it should be 1 PL per 20 working days considering 300 working days in a year, not 240 days. Please check.

Dear Professional,

The concept of 240 working days is the eligibility criteria for ELs. If the employee does not work for 240 days in a year (i.e., 12 months), they are not eligible for EL/PL in the following year.

Similarly, if an employee joins at any point in the calendar year, they become eligible for EL/PL once they have completed 2/3 of the total working days.

For instance, if a person joins on 01.08.2010, the total number of days to work in 2010 is approximately 125 days. If the person has worked around 80 days, they are eligible for 4 PLs in the next year. If the person works fewer than 80 days, they will not receive PLs in the following year.

I am also seeking information about CLs. Could you please specify the section under the Factories Act that addresses CLs?

Understanding Leave Policies Under the Factory Act

Chapter VIII and Section 79 of the Factory Act discuss only Earned Leaves (ELs). However, Casual Leave (CL) and Sick Leave (SL) are based on local policy, which can differ from company to company. The Factory Act does not address anything about CL or SL.
