How Can I Get 365 Days Opening Permission for Retail Showrooms Across India?

gautampatel05
I am working in the retail industry. We have 10 showrooms in Gujarat, UP, Delhi, Maharashtra, and AP. I want to know if there is any procedure for obtaining 365 days opening permission. If there is a specific format, please share it with us.

You can contact the local labor department for permission to operate 365 days under the Shops & Establishment Act. You can also obtain the necessary format and forms from the Shops & Establishment Act.

Kuldeep ji has rightly answered your query. Granting permission to keep a shop/factory operating 24x7 falls within the jurisdiction of the appropriate government authority. Each state has its separate procedures, forms, and formats. It is advised that you approach the respective authority in each location.

Here is the guidance from my son, who is a VP in an FMCG company and himself controls several showrooms of the company:

- For 365 days showroom openings, apply for permission to operate on all days to the Shops and Establishments department in each city. Only the Shops and Establishments department can waive the mandatory weekly off for all commercial establishments.
- A letter needs to be submitted stating that the concerned shop will provide a weekly off, on rotation, to all members of the shop.
- A register, in the prescribed format, will have to be maintained to show attendance and weekly off for each member of the store in rotation.

The procedure is quite straightforward but has to be done separately for stores in each city. Additionally, there are rules that prevent working beyond 8 pm or before 6 am.

You can open 365 days. You need to ensure that every employee gets a weekly day off. You can allocate alternate days for weekly offs to each employee. Additionally, you can apply for permission to open on national and festival holidays due to the nature of your business. National and festival holidays are essential in every state under the Shops and Establishment Act, though they can vary from state to state. Regarding weekly offs, they are compulsory.

Thanks,

Sir, we are located in taluka area in Maharashtra, where the Shop Act does not apply, but we have Sarpanch NOC for the same. Please let me know how to obtain a 365-day operating license in such cases.
