How Can We Recover Our Unpaid Salaries from a Company Closing Down? Seeking Advice on Next Steps

I need your assistance and guidance. I joined this organization on February 8, 2010, and left on April 23, 2012. However, my full and final settlement has not been completed yet. The employer's response has consistently been that there are "No funds available," and they will process it when funds are available. However, I have learned that they are winding up operations and relocating the brand to another division, indicating that this division or company will be closing down. It seems their intention is to avoid paying former employees.

Currently, there are approximately 10-12 employees still working in the support department who have not received their salaries since November 2012.

I kindly request your guidance on how we can recover our hard-earned money from them. The company in question is Yash Birla Group (Mumbai).

Thank you.
Reema S.
Please approach the labor office with your colleagues who haven't received their outstanding salaries/settlement dues. They would definitely help you out. Make sure you have all the documents supporting your employment with the company.

Thanks,
Reema

You can also consult a lawyer who can assist you by filing your petition in the local labor court.
