Stuck Without My Final Paycheck: What Legal Steps Can I Take Against My Former Employer?

I worked in a Mumbai-based pharma company, Rytus Therapeutics, from Jun'2011 to Dec'2011. My query is that even after more than a year of leaving their services and sending them numerous reminders through mail, SMS, phone calls, etc., they are not releasing my Full and Final (F&F) cheque. I have cleared all the dues from my side. They have released my PF, but they are not releasing my F&F cheque.

Legal Measures Against Non-Release of F&F Cheque

My query is, what legal measures may I opt for against this company? Kindly guide me regarding the same. Thank you.

Thank you for your reply. However, I have already asked the HR of the company several times to provide me with my Full and Final settlement. Despite reminding them multiple times, they have not provided the same.

Reasons for Not Releasing Payments

Ask them what the reasons are for not releasing the payments, and then we can proceed accordingly. I can say the following are the reasons for not releasing the F&F:

• Your attitude while you were working with them,
• Not serving the notice period,
• Any issues with the company.

Hi! Thanks for your prompt reply. However, I don't think any of the three points you cited stand valid in my case. On the contrary, the company put a hold on my salary for Nov '11 with reasons best known to them. Now, that salary has been included in my F&F. The company is deliberately telling me to wait for some more days (it's been more than 1 year!). Kindly advise me on the necessary steps.

Hi Ashok Negidi, you are also acting like that company. Despite having written several emails, there is no suggestion on how to get your Full and Final settlement.

- Do you have any Full and Final settlement statement from the company's official email ID?
- What is the reason for leaving the company?
- Have you ever received any warning letters from the company regarding your performance, etc.?

Thank you for your reply. At least you pointed out the concerns correctly. First of all, yes, I have received the full and final settlement from the company HR's official mail ID. As it was a launching company, there was tremendous pressure from the start. However, I contributed in my own little way to the sales. Now the company's MD and VP are saying that unless they are making a profit from this East region, they can't release my full and final settlement. Also, they have not given me any official warning letter.

Kindly advise me on this matter.
