Facing Workplace Harassment: Should I Take Legal Action Against My Boss?

sosochauhan
My senior CSO of the company used very rude and abusive language in the office and asked me to leave this organization on the spot. I am a top performer in my department and have received RNR twice for my performance. I don't have any other problems like behavior issues or work-related issues; all my statuses are good.

Seeking Advice on Legal Action

Now, suggest to me what I should do. I want to take legal action against him.

Please try not to disclose your company's name. You are working there as a Senior HR Executive. What is your immediate boss's opinion about this? Share it so we can guide you on the necessary steps. Please share what caused your CSO to use abusive language.

I have already talked to my manager, and my manager is also fed up with him. Additionally, my entire HR team is fed up with him.

Now, please suggest what to do in this case.

You have written, "I have talked to my manager, but you have not written what he said," and you have not mentioned what made the CSO use abusive language. Unless we get some information, we cannot advise you. Write descriptively rather than objectively.

I have experienced unprofessional behavior from my manager, as he uses abusive language (such as "what the fxxk," "you are a fxxker," "Axxxxhole," "bloody fxxker") towards me. Additionally, he has called security to remove me from the cabin and the office.

Seeking Advice on Writing to Senior Management

I want to write an email to senior management regarding this issue. Could you kindly suggest in which language I should write?

Based on your posting, here are the other details needed that would enable the members to give realistic suggestions.

1. Does your Sr. CSO behave the same way with other HR staff too?

2. You mentioned that you spoke to your manager regarding this issue—what did he say, and did he bring it to the attention of the management? If not, why not? And if yes, what was the result?

3. What was the actual situation when your Sr. CSO abused you? I am sure that must have been his response—to what?

4. When the abusive incident happened, were there any other employees around who witnessed what happened?

5. Was this the first time it happened, or did such situations occur earlier too? If yes, did you take it to the attention of your HR boss—and what was his/her response/reaction?

Please give all the details so that the member responses will be more accurate. Please note that the focus of the members will be to give you accurate and realistic solutions, rather than a one-off response, which might affect your career adversely.

Yes, he is exhibiting this kind of behavior on a regular basis, and the female staff, including my manager, who is also female, are aware of it. As I mentioned, he continues to do this, which is why I am so confused about what to do. This behavior occurs regularly, and my manager is also on notice period. She was present when he was doing all this, and the management staff, like the center head of my organization, was also there. My other team members were standing outside the cabin, and they are all aware of this case.

This time, it happened during a regular feedback meeting on internal hiring in my organization. I would like to mention that I am a top performer in my team, and I handle the hiring part and other issues of my organization. According to me, after delivering such a strong performance, this kind of behavior should not be acceptable.

Now, kindly suggest what to do about the same.

Saurabh

I understand your agony and problems. Before deciding on something really harsh, just put on your thinking cap.

1. Whether the CSO has abused you without any justification.
2. Even while scolding, has he used any unparliamentary words? In your email, you mentioned some foul language he has used.
3. Have you recorded his scoldings? Nowadays, there are plenty of gadgets available to record someone's speech. This will serve as evidence for you in case you are asked to submit proof.
4. Last but not least, does his scolding or abuse have a reason behind it? i.e., Are you at fault for his scolding? Have you committed any blunders he can't tolerate?

Consider all this and come to a conclusion on how to plan for the next course of action.

Best of luck and regards.
