Termination Without Notice and Claiming Dues

I, Mr. Gunvant Solanki, am working in a Pvt. Ltd. company which was earlier a partnership firm. Our company did not provide PF, but they offered the employees a PPF amount of Rs. 350, citing that there were not more than 20 employees.

I visited Vaishno Devi temple last month and had submitted a leave application to my boss, but it was not approved as I had only 4 days of leave available. Upon my return from Vaishno Devi, the company sent me a termination letter stating that I am terminated from my job without any notice period. They have not paid me my last month's salary for January 2013 and have not provided any reason for the termination.

I need to claim my dues from the company, including my remaining PF, conveyance, and gratuity. I have been working there since February 2009.

Please advise on the further course of action to be taken to clear my dues from the company at the earliest.

Talk to the HR personnel first, then draw any conclusions. Since you received the termination letter, it must have mentioned the reason for termination. Regarding Notice Pay, if it is specified in the Appointment Letter, then you are eligible for it. Finally, concerning your other outstanding payments, they should be settled in your Full and Final Settlement. Kindly inquire.

You need to inquire with the HR department and rush to the labor court if the outcome is negative. This action will put a lot of pressure on your employer.
