Did You Know Forklifts Need RTO Registration? Here's What I Found Out!

Sharing a document that came to my attention while I was checking the requirements for a forklift. I discussed the same with my professional friends and got to know that a forklift is also required to be registered by the RTO as it has been identified as a "Non-Transport Vehicle" as per Subsection 4 of Section 41 of the Motor Vehicle Act 1988. Thank you for the update on an important topic. As an extension of the above discussion, is it mandatory to ensure that all persons driving forklifts inside a factory premises have a valid driving license from the RTO? I am asking this question specifically from a legal viewpoint. I know they should preferably have a license.

Forklift Registration Requirements

Forklift registration is required, but the tax is as per a non-transport vehicle. I think all tire-mounted equipment is covered under the Motor Vehicles Act. I don't think any registration formalities are required for crawler-mounted equipment.

Forklift is a non-transport vehicle, so no license is mandatory if not using public roads regularly for commercial purposes.

Forklift Licensing Requirements

Rules for forklift operation vary from state to state, but generally, such notifications are not actively tracked. It is recommended to adopt a better and standard practice of obtaining a license or authorization in your state. If the state government does not provide such authorization for legal purposes, write an application to the RTO regarding the applicability of such licenses and proceed according to their response. This is important because if anything happens later due to not having the required licenses, such documents will be crucial. In Maharashtra, a separate license is required to operate a forklift.
