Sir, I have an interview with a bank in 10 days for which I need to take an NOC from my current employer. I am working on a contractual basis in a government corporation. In my contract, it is mentioned that "Both parties may terminate the contract by giving one month's notice or full pay in lieu thereof to the other party." My current corporation has denied issuing me the NOC. So, in this situation, do I necessarily need to produce an NOC to attend the interview scheduled in 10 days?
"Any employee who resigns properly by following the terms and conditions of employment deserves a proper F&F and an 'Experience Certificate with Relieving Letter' regardless of being on a contractual or a permanent job."
Please clarify what you actually require in your case, an NOC or a relieving letter?
If you are an employee of an organization and have to attend an interview soon because you are looking for a change, you don't require any NOC or permission from your present employer, nor will your interviewer ask for any kind of permission/NOC from your current employer.
Because "NOC is required in cases where the terms and conditions of employment restrict or prevent an employee from joining any competitor/company in the same industry," but if the employee works in a different industry/company and has not agreed to such terms of employment, only a relieving letter is required.
Please share your current industry/company type.
Regarding the "Relieving Letter," it is only required at the time of joining a new company/future employer. It is a form of assurance to the employer by the candidate and the past employer of the applicant that he/she is no longer an employee of the previous company and is free/allowed to join any corporation/company/industry and has gained work experience.
