Do We Need Labour Office Approval for Our Holiday List? What's the Process?

Mangesh S
Please suggest whether we need to obtain approval for the Holiday List from the Labour Office. If yes, what is the procedure?

There is no provision in the law for seeking approval from the labor office for the holiday list. However, you need to obtain permission for operating 24x7.

Approval of Leave for National and Festival Holidays

Approval of leave is mandatory as per various state enactments regarding National and Festival holidays. It is also to be ensured that festival holidays falling on Sundays shall be substituted by another festival holiday.

Approval Process for Holiday List in Tamil Nadu

In Tamil Nadu, one must obtain the approval of the concerned Assistant Inspector of Labour by filing Form I & II of the National and Festival Holidays Act and having it approved by him in Form III. Apart from the four National Holidays, namely January 26th, May Day, August 15th, and October 2nd, five festival holidays need to be indicated with the consent of the majority of employees. The approved Form III should be exhibited in the organization. If any changes are required, necessary amendments should be sent and approved by him. In total, nine holidays have to be declared in a year. Every year, in the last week of December, you must submit the list of holidays in Form V to the Labour Inspector.

Thank you very much, Madhu T K Sir, for enlightening. The rule of substituting a festival holiday falling on a Sunday with another festival holiday can be applied to employees who take their weekly off on days other than Sunday. Kindly suggest.

Submission of National and Festival Holidays

We have to send the declared national and festival holidays, totaling nine, compulsorily in Form V under the T.N. National Festival Holidays Act of 1958 before 31st December to the Local Inspector of Factories in triplicate.

Application Process for New Companies

For a new company, the application should be made in Form I, and the same will be approved by the Inspector of Factories in Form II, which should be retained. Whenever an inspection is carried out, this form should be produced on demand.

Yes, Singh, it is applicable to establishments that operate on a 24x7 basis as well. This is because Sunday is treated as a public holiday by the common notification issued by the government, and the official notification of the government governing the holidays for the year will always show Sundays as closed holidays.

Dear Sir,

Yes, it is mandatory to obtain approval for the national (4) and festival (5) holiday list from the labour office. We need to collect and fill out Form V, stating the national and festival holidays for the following year. This form should be sent for approval to the labour office before the end of December. It is essential to keep the acknowledgment copy with us.
