How Are Employee Leaves Deducted: Monthly or Yearly? Seeking Clarity on Leave Policy

Query Regarding Leave Deduction

I have one query regarding leave. We are providing 35 leaves per year (per calendar year): 7 CL, 7 SL, and 21 PL. If an employee takes 7 leaves in January 2013, will it be deducted from their monthly credit or the yearly credit provided by the company? If it is deducted on a monthly basis, then they would be entitled to LWP for any excess leave taken beyond their monthly credit.

The candidate has been working for a long time. Please advise.

It depends completely on your policy and, more so, on the culture and beliefs of the company. How did it work before? In my firm, we have similar leaves for the year, which amounts to 1 leave in 20 days accumulated throughout the year. At the end of the year, SL and CL lapse, PL is encashed, and hence lapsed.

We have allowed SL though; one can't prevent someone from taking leaves for a genuine reason. A person took SL as she underwent surgery, produced the medical certificate and bills, so that was paid leave. Surely, the paid leaves entitled to her are reduced by 4 instead of on a pro-rata basis, and we did not deduct the salary.

For CL and PL/EL, in my company, it depends on a case-to-case basis. However, in usual scenarios in bigger firms, leaves are on a pro-rata basis. So, if you take more than the granted leaves per month, that becomes your leave without pay. But, as I said before, it differs from company to company and policy to policy. Why don't you seek advice from your seniors on this?

As per the Andhra Pradesh Shops & Establishment Act 1988, how many sick leaves is an employee entitled to in a year, and how many sick leaves can be carried forward to the next year? Please clarify.

Leave Entitlement and Accumulation

Every employee who has served 240 days or more during a continuous period of 12 months in any establishment shall be entitled, during the subsequent period of twelve months, to leave with wages. This leave may be accumulated up to a maximum period of sixty days.

Sick Leaves

12 days

Casual Leaves

12 days

Encashment of Leaves

Every employee in any shop or establishment shall be entitled to encashment of leave with wages for a period of 8 days in a year.
